If your building is covered, you owe an annual energy filing to the City of Boulder. We collect the utility data, build the record, and file it, and we tell you early if the building was never covered at all.

What Boulder requires
Who is covered 50,000 sq ft, commercial only The Building Performance Ordinance covers commercial and industrial buildings only. Condominiums, cooperatives and residential multifamily are not covered.

What the filing is, and what makes it hold up.

Benchmarking is a measurement exercise. Once a year you report whole-building energy use, floor area, and how the space is used. It does not by itself require you to change anything about the building.

What it does is set the number every later obligation runs on, from your performance position to the questions lenders and appraisers ask. A filing made with the wrong square footage or a missing meter quietly becomes a compliance problem a year or two later.

There is no third-party verification requirement here today, which means the quality control on the record is ours to own rather than a regulator’s to catch.

Commercial and industrial only
Condominiums, cooperatives and residential multifamily are outside the ordinance. That is a real scope reduction for the right building.

Covered commercial buildings file with the city and the state, and the state fee still applies.

If the filing is late

Two filings for commercial buildings, and none for condominiums.

Boulder is the jurisdiction where knowing the coverage line saves the most money. Commercial buildings owe two filings and a state fee. Residential buildings owe the state only.

Because the regime is prescriptive, the compliance record is a documentation exercise: proof that the audit happened, the lighting was done, and the retrocommissioning was completed on schedule.

State programme correspondence
Because Boulder has no deemed compliance, a covered commercial building receives state letters too and owes the state fee.

Boulder benchmarking questions

Coverage here turns on building use as much as size: commercial and industrial only at 50,000 sq ft and above, with residential multifamily outside the ordinance. Send us the address and we will confirm it against the jurisdiction’s own records rather than estimating.

The annual date is June 1 for the city, and the state programme has its own season closing November 1. A covered commercial building has both.

A separate residential rental requirement that applies to individually rented units rather than to an association. It is often confused with the commercial ordinance and it should not be.

The city has been moving toward pulling larger multifamily into the ordinance. We watch that rather than assume it, and we will tell you when it affects your building.
