April 1st, 2023 marks the first deadline for the DC Building Energy Performance Standards (BEPS). Properties over 50,000 square feet with an Energy Star Score below the DC median score, and multifamily buildings with a score of 66, must report their selected compliance pathway by this date.

A letter from the DC Department of Energy and Environment has been sent to the affected property owners with instructions on how to proceed. Properties are required to choose a compliance pathway through the online BEPS portal by April 1st, 2023.

Here’s an excerpt from this letter: “

“Building Energy Performance Standards Compliance Pathway Selection due April 3rd, 2023”. The letter goes on to direct property owners that, “pursuant to the CleanEnergy DC Omnibus Amendment Act of 2018…, property owners and managers of buildings larger than 50,000 gross square feet are required to meet the… BEPS. Buildings that did not meet the BEPS as of January 1, 2021 are required to complete the energy performance and reporting/verification requirements of a Compliance Pathway.

This building does not meet the BEPS. You must select a Compliance Pathway through the Online BEPS Portal by April 1st, 2023.”

There are four pathways to choose from, but 95% of buildings are expected to choose either the Standard Target Pathway or the Performance Pathway. The Standard Target Pathway is easier for buildings with Energy Star Scores above 50, requiring a score of 66 for multifamily buildings. The Performance Pathway requires a 20% reduction in energy usage for properties with scores lower than this.
