What the standard actually asks of a building.

Colorado sits between a reporting programme and a performance standard. Data goes in during a season rather than on a date, a per-building fee applies annually, and performance targets phase in with 2030 as the binding milestone.

The 2026 position is widely misunderstood. What happened was a conditional non-referral, which is a pause on enforcement referral rather than a repeal of the obligation. Buildings that treated it as a cancellation are the ones that will be short of time in 2029.

The condominium question is mechanical. Coverage depends on whether heating, cooling or hot water is shared and centralised, which means the screening question is about plant rather than about paperwork.

Colorado applies penalties at the building level and charges an annual per-building fee regardless. The programme cost is predictable, which is unusual and helpful for budgeting.

The real exposure is timing. A building that reads the 2026 conditional non-referral as a repeal and does nothing for three years arrives at a binding 2030 target with no runway.
